Terms of use
Last updated 19 Oct 2026
The service
Ekomara is operated by ENOMARA Investments Ltd, Nairobi, Kenya (“we”, “us”). It gives a business a shared inbox for customer conversations, starting with WhatsApp, together with contacts, a sales pipeline, reply deadlines, tasks and a catalogue. These terms apply to everyone who creates an account or works in a workspace. By creating a workspace you accept them for your business, and you confirm you may do so.
Early access and pilots
Ekomara is in early access. Features may be incomplete, may change and may sometimes be unavailable while we build. Some businesses take part in a pilot on terms agreed with us in writing; where those terms differ from these, the pilot terms apply. We will not charge you for Ekomara unless you have agreed a price with us first.
Accounts and workspaces
- Use your real name and an email address you control, and keep your sign-in details to yourself.
- Workspace owners and admins decide who joins, which role each person has and when someone leaves. Everything done in a workspace is done for that business.
- Tell us at [email protected] straight away if you think someone else has used your account.
- You must be at least 18 to use Ekomara.
Your business’s data
Your workspace data belongs to your business. You allow us to host, copy and process it only as needed to run Ekomara for you. For the personal data in it, your business is the controller and we are your processor, so we:
- process it only to provide Ekomara and as you instruct;
- keep it confidential, and let only the people and service providers who need it to run the service handle it;
- protect it with appropriate security measures;
- help you answer requests from the people it is about;
- tell you without undue delay if we become aware of a breach affecting it;
- delete or return it when you stop using Ekomara, unless the law requires us to keep it.
Your business is responsible for having a lawful basis for the data it brings in and for the messages it sends, including getting its customers’ consent where the law or WhatsApp requires it, and for honouring every request to stop. Our privacy notice explains how we handle personal data.
To connect WhatsApp you need your own WhatsApp Business account with Meta. You must follow the WhatsApp Business Messaging Policy, the WhatsApp Commerce Policy and the other Meta terms that apply to you. Meta can limit or block a number on its own decision, and any charges Meta makes for your WhatsApp messaging are between you and Meta.
Acceptable use
Do not use Ekomara to:
- send spam, or bulk or automated messages to people who have not contacted you or agreed to hear from you;
- message anyone who has asked you to stop;
- send content that is unlawful, deceptive, harassing or hateful, or that infringes someone else’s rights;
- sell or promote goods or services that the law or the WhatsApp Commerce Policy prohibits;
- bring in personal data you have no right to use;
- probe, overload or get around Ekomara’s security, reach another business’s workspace, or copy the service by scraping or reverse engineering it.
If a workspace breaks these terms or puts people, phone numbers or the service at risk, we may pause its sending or suspend it. We will tell you why, unless the law or a security reason prevents us.
Changes to the service and to these terms
We may add, change or remove features. We will try to give notice before a change that takes away something you rely on. When these terms change, the date at the top changes with them; if you keep using Ekomara after that, the new terms apply.
Ending
You may stop using Ekomara at any time. To close a workspace or an account, or to get a copy of your workspace data first, write to [email protected]. We may end early access or a pilot with reasonable notice, or straight away if a serious breach of these terms requires it.
Availability and liability
We work to keep Ekomara running and its alerts on time, but early-access software can fail, and networks, Meta and devices can delay or stop messages and alerts. Ekomara is provided as it is, with no promises beyond those in these terms. As far as the law allows:
- we are not liable for indirect or consequential losses, or for lost sales, profits, customers or goodwill;
- we are not liable for what Meta or other third parties do, or for the messages your business sends;
- our total liability for anything arising from Ekomara is limited to what your business paid us for Ekomara in the twelve months before the claim.
Nothing in these terms limits a liability that the law does not allow to be limited.
Law
These terms are governed by the laws of Kenya, and the courts of Kenya decide any dispute. Before going to court, please write to us at [email protected] so we can try to resolve it together.
